Terms of Service

These Terms of Service ("Terms") govern your use of the New York Cue Club member application available at members.nycueclub.com (the "Service") operated by New York Cue Club, LLC ("NYCC", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
Eligibility
The Service is intended solely for members of New York Cue Club. To create or maintain an account, you must:
- Be at least 21 years of age.
- Have an active New York Cue Club membership in good standing, or be an applicant whose application is in review.
- Provide accurate and complete information during onboarding and keep your account information current.
Membership Agreement and House Rules
These Terms cover your use of the Service. Your conduct at the club, your membership privileges, and your obligations as a member are governed separately by the New York Cue Club Membership Agreement and House Rules, which you sign or acknowledge as part of your membership. In the event of any conflict between these Terms and the Membership Agreement or House Rules, the Membership Agreement and House Rules govern matters of membership and club conduct, and these Terms govern your use of the Service.
Account security
You are responsible for maintaining the confidentiality of your account credentials, including your verified email address, phone number, and any login codes sent to either. You agree to notify us immediately at support@nycueclub.com of any unauthorized access to your account.
Communications
By creating an account and verifying your phone number, you consent to receive electronic communications from NYCC by email, in-app notification, and SMS, as described in our Privacy Policy. You may manage your communication preferences within the Service. You may opt out of SMS messages by replying STOP to any SMS message.
Acceptable use
You agree to use the Service only for purposes permitted by these Terms and applicable law. You agree NOT to:
- Use the Service to harass, abuse, or harm another member or staff person.
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
- Attempt to gain unauthorized access to any part of the Service, to other accounts, or to systems or networks connected to the Service.
- Use the Service to transmit any unlawful, infringing, or harmful content.
- Reverse engineer, decompile, or disassemble any portion of the Service.
- Use any automated means (bots, scrapers, etc.) to access or collect information from the Service except as expressly permitted by us.
Reservations and club resources
Reservations made through the Service are subject to club booking rules, including quotas, cancellation windows, and no-show policies, as described in the Membership Agreement, House Rules, and the Service. Failure to comply with these rules may result in restrictions on your booking privileges.
Door access and presence verification
The Service includes a door unlock feature for members in good standing. You agree to use this feature only for your own access to the club and not to grant access to non-members or other persons. The Service may verify your physical presence at the club using your device's Wi-Fi connection or geolocation when you check in for reservations or unlock the door.
Payments
Membership fees, locker fees, snack purchases, and other charges are billed through the Service via our payment processor, Stripe. By providing payment method information, you authorize NYCC to charge that payment method for amounts you owe under your Membership Agreement and these Terms. Disputes regarding charges should be raised promptly with NYCC at support@nycueclub.com.
Intellectual property
The Service, including its software, design, content, and trademarks, is owned by NYCC or its licensors and protected by copyright, trademark, and other laws. These Terms do not grant you any right to use NYCC's trademarks, logos, or proprietary content other than as necessary to use the Service.
Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, NYCC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Limitation of liability
To the maximum extent permitted by law, NYCC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any direct damages will not exceed the amount you paid to NYCC in the twelve months preceding the event giving rise to the claim.
Account suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms, the Membership Agreement, or the House Rules. Upon termination, your right to use the Service ceases immediately. Termination of Service access does not by itself terminate your underlying membership; the Membership Agreement governs membership termination separately.
Changes to the Service or these Terms
We may modify the Service or these Terms at any time. We will indicate changes to these Terms by updating the "Last updated" date at the top of this page. Material changes will be communicated to members via the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
